And for me personally, that means it's time to think about the Oct 2023 Sunshine Newsletter. Yep, that's right, you all need to start thinking about those great articles you are going to be composing and sending to me, the once-again Sunshine Newsletter Editor. Normally you will be getting Newsletter Reminders on the 17th and 23rd of each month from September thru February. But since this is the first edition of the season, I'm giving you an early reminder. I spent part of Saturday reviewing and making some slight updates to the Newsletter Guidelines. The updated document is available on the website HERE . Again, I’m thinking this first Newsletter in particular, would be a great opportunity for everyone who manages or participates in one of our clubs (like Women's Club or Rock Painting) or activities (like Golf) to ‘get the word out’ about them. I’m hoping that you provide the following types of information for this Newsletter, in addition to the normal Activities info for the month of October: Club/Activity Name Contact Name(s) Is there a Board? Do you ‘meet’? If so, where and when? Are meeting minutes, etc. provided? General Description. Some of this info is on the Website (but may need to be updated ) HERE AND HERE . What needs to be updated/corrected on these pages? What else can be displayed on these pages? What additional pages do we need/want? This is a perfect opportunity: For you to review and become more familiar with the Website . For me to get the Website updated with current and correct info. This Suggestion/Complaint was an agenda item for the Dec 14, 2021 Board meeting. As stated in the minutes from that meeting (see below) the Board updated the SEPO "Policies & Procedures" to address this issue. ​ Excerpt from minutes for the Dec 14, 2021 Board meeting: Feeding of Ducks on Golf Course: ​ ​DISCUSSION: Lenore read the following: Per TX Parks & Wildlife it is an offense to feed or offer any wildlife or exotic wildlife unsecured in a manner that makes food available to wildlife or exotic wildlife unless specifically authorized. The Board agreed the community needs to be educated concerning this matter and there wasn’t a need to impose fees. We will put up signs – where TBD – and emphasize all of this in the next Sunshine Newsletter. AMENDED MOTION: Lenore moved and Beth seconded to update the Policies & Procedures with the following: GOLF COURSE “Feeding ducks on the golf course is prohibited.” Per the TX Parks & Wildlife, it is an offense to feed or offer any wildlife or exotic wildlife unsecured in a manner that makes food available to wildlife or exotic wildlife unless specifically authorized. The feeding of birds can be permitted using feeders that contain food in a specific area. DISCUSSION: We continue to have resident turnover and there needs to be ongoing education. Beth suggested it be included in the new homeowner ‘Orientation’ materials. VOTE on Amended Motion: Beth, Lenore, Jean and Mark voted YES. Lyn voted NO. SEPO Board ​ Sent 2021-12-30: SEPO SUGGESTION: Vendor Program - Outcome - As part of the SEPO Suggestion process the Board adopted on July 20, 2021, we want to ensure the community aware of the resolution of the SEPO Suggestion concerning the reinstatement of the Vendor Program. This suggestion was an agenda item for the Dec 14, 2021 Board meeting. As stated in the minutes from that meeting (see below) the Board voted ‘not’ to reinstate this program. ​ Excerpt from minutes for the Dec 14, 2021 Board meeting: Tony/Board – SEPO Suggestion from Resident: Reinstatement of Vendor Program We have not had this program for the past two years. The Board has not been made aware of any problems without it. The administration of this process is not easy. The Vendor Program was a process for identifying unmarked vehicles which were legitimate contractors hired by a resident to do work. This program had been in effect several years when a previous Board voted to dissolve it. Lenore has a protocol for the program. There was discussion on the inability to guarantee a vendor was displaying the proper credentials every time he entered the premises and how it is difficult for residents to ‘police’ it. It was proposed that everyone keep an eye on suspicious activity at their neighbors’ house and inform/question their neighbors of such. MOTION: Lyn moved and Mark seconded to ‘not’ reinstate the Vendor Program. VOTE: Beth, Mark, Lyn and Jean voted YES. Lenore voted NO. This Suggestion was an agenda item for the Dec 14, 2021 Board meeting. SEPO Board ​ Sent 2021-12-30: SEPO SUGGESTION: Clarify "When & Where" pets need to be on a Leash - Outcome - As part of the SEPO Suggestion process the Board adopted on July 20, 2021, we want to ensure the community is aware of the resolution of the SEPO Suggestion to "Clarify When & Where pets need to be on a leash". This Suggestion was an agenda item for the Dec 14, 2021 Board meeting. At this meeting the Board clarified the - "Policies & Procedures" clearly state: All pets must be kept on leash when not on the owner’s property. "Covenants" also state: All pets must be kept on a leash when not confined to OWNERS’ lot. The Board will continue discussion on 'pets on leashes' as described in the excerpt from the Dec 14, 2021 Board meeting minutes below. Excerpt from minutes for the Dec 14, 2021 Board meeting: We received a SEPO ‘Question’ from a new resident asking where pets could be leash-free. Tony indicated it was defined in both the Covenants and the Policies & Procedures that, unless your pet is on your personal property, it must be on a leash. To not do so is a violation of our current governing rules. It would take a 66% vote to amend the Covenants. MOTION: Lyn moved and Mark seconded we put it on the ballot to do away with the leash law. In its place we create some sort of language stating the owner is responsible for their own pets. VOTE: The motion passed unanimously by all Board members present. Please refer to the Meeting Minutes, which will be published HERE in a couple of days for additional information regarding this item. ​ POLICIES AND PROCEDURES OF SUNSHINE COUNTRY CLUB ESTATES APPROVED BY ITS BOARD OF DIRECTORS December 14, 2021 (All previous Policies & Procedures are replaced by this Update of December 14, 2021.) ​ ARCHITECTURAL CONTROL Owners wishing to make additions or any outside improvements/changes to their property must complete a proposal form obtained at the SEPO office to receive permission from the Architectural Control Committee (ACC) and may not commence work until the necessary ACC approval has been obtained. Owners who proceed without ACC approval are subject to imposition of the “Rules and Regulations Pertaining to Non-compliance to Covenants Fee Schedule” and legal intervention as identified in these SEPO Rules, (adopted August 31, 2021). See document HERE . In the event of noncompliance with the foregoing paragraphs the Architectural Control Committee shall report such conduct to the SEPO Board who will in turn issue a STOP WORK ORDER until approval is obtained from the ACC. In the event work continues, then the SEPO Board may impose FEEs in the amounts defined in the Non-compliance to Covenants Fee Schedule (linked to above). If the fees are not collected, a lien may be placed upon the owner’s property. You may not expand upon or change that work which has been approved without submitting a new plan. As to fences, Exhibit B of the Covenants states in paragraph 16, “no fence, wall or hedge shall be built or maintained nearer than ten (10) feet to the front curb line of any lot, or side curb line on corner lots. An exception shall be retaining walls of not over twelve inches above the ground.” Paragraph l7 states, “No fence, wall or hedge or shrub planting which obstructs sight lines shall be placed or permitted on corner lots.” Paragraph 18 states, “All fences shall be approved prior to construction.” Paragraph 19 states, in part, “No lot owner shall impair any easement. No fences, walls or structural improvements shall be built or constructed on any easement.” For clarification, our lots have a ten foot utility easement from the lot line across the front and a five foot utility easement from the lot line across the back. That in itself declares no fences will be allowed within the five foot rear lot easement adjacent to the golf course. Owners are allowed to erect a barrier for golf ball protection. They must be approved by the ACC. Protective measures for golf balls can include a type of netting or other material but cannot be intrusive on neighbors. All Fences and Barriers must be approved by The ACC prior to installation. If you are not participating in the Men’s or Women’s scheduled Golf League play, you must wait until the entire League play is completed before gathering to play. Golfers who wish to play ‘after League play has completed’ are requested not to stage at Hole #1, as this has shown to prevent League players from using the cart paths to advance on the course. Non-League golfers should gather on Michigan Avenue, away from the cart path, in anticipation of League play completion, in order to reduce congestion on Hole #1 tee box. This effort begins with Sunshine volunteers from the Women's Club to chair these events: (1) the "Angel Tree" program, and/or (2) Bell Ringing the day after Thanksgiving and/or (3) other possible programs(?) the Salvation Army is involved in. For Now: The SA is behind in funds for their Christmas program and any contribution would be a miracle. That's really unfortunate because blackie is perhaps one of the best friends in nature that we can have. Blackie is officially known as a Texas indigo snake. Now you are probably repulsed by the idea of a snake being our best friend. But do not fear but rarher respect blackie because blackie eats other snakes, poisonous ones as well as a wide variety of other small creatures. Blackie is neither poisonous nor aggressive but really a very placid creature. Most adult indigo snakes grow to between 5½ and 6½ feet in length. The longest recorded indigo snake was nearly 8½ feet long. If an owner wishes to pay for their house golf guest they may do so by keeping track of the number of times their guest plays and pay the proper amount after the guest leaves. The medallions are free and can be obtained from the office. Your name will be put on the medallion before you exit the office. SEPO GIFT & MEMORIAL Fund Ref: SEPO ByLaws - ARTICLE VII - 05 - CHECKS, DEPOSITS AND FUNDS All funds accumulating in this fund shall be administered by a committee of five (5) members to be appointed by the Board of Directors. Each member shall serve for a term of three years with new members being appointed as vacancies occur. Duties of this committee include the keeping of detailed records of contributions including the names of those wishing to be remembered or in whose honor a contribution is made and the amount given. Although consideration will be given for a specific memorial item requested by the donor, the committee will not be restricted to that use taking into consideration the overall needs and appropriateness of the particular memorials. The committee shall act as an advisory committee to the Board of Directors in the use of said funds from time to time. POLICY & PROCEDURES OF SCCE PG. 7 Donations to SEPO When an individual, committee or organization purchases “something” for SEPO, then ownership becomes SEPO’s unless explicitly noted otherwise. Once accepted by SEPO (either explicitly or implicitly), future maintenance, usage replacement or removal will be SEPO’s responsibility and expense. If SEPO has ownership, the Board will have sole discretion for its usage and whether replacement or removal is in SEPO interest at that time. There is no guarantee of replacement. If ownership remains with the donor, then future maintenance, usage, replacement and removal will be the owner’s responsibility and expense, however SEPO may request its removal at any time for any reason or no reason. Beth Parrish SEPO Web site Admin ​ Sent 2022-01-16: INFO/WHERE TO FIND Proposed Amendments to SEPO Bylaws & Covenants for 2022 Vote - The Governing Rules documents you are being asked to vote on in the 2022 election, which contain proposed amendments to the Bylaws and Covenants, have been posted on the Sunshine Web site HERE . The ballots for voting on these amendments, along with voting instructions, were mailed to the entire community via US Postal Service on Friday, January 14, 2022. Between the asterisks below is one of the pages you will be receiving in your ballot envelope. Here is a bit more comprehensive explanation of how the voting percentages works: Amendments to our existing Bylaws can only be made if 51% of the "total" votes cast are yes. Amendments to our existing Covenants can only be made with at least 66% yes votes from the owners (202 yes of the 306 owners). ******************************** CONCERNING PROPOSED AMENDMENTS TO SEPO Bylaws and Covenants The SEPO Board appointed a Review Committee of knowledgeable Owners in March 2021 to review our SEPO Bylaws, Covenants and Policies & Procedures. This Committee consisted of Share Nelson, Pat Harvey, Jerry Wetherbee, Earl Weir and Steve Fransene. After intense review, the committee provided a report to the Board. The Board accepted this report and proceeded to undertake significant effort to review their recommendations, ultimately forwarding them to our Attorney. The Attorney provided input to the Review Committee recommendations and also provided updates to our Bylaws and Covenants pertaining to current Texas Property Code. After another intense Board review and consideration of Owners’ comments, the Board approved to ‘move forward for a vote’ documents containing proposed amendments to our Bylaws and Covenants. The proposed amendments in both documents are classified as: Necessary to follow the current Texas Property Code, or Corrective, editorial, and / or changed for clarity (without changing the intent). Amendments to our existing Bylaws can be made with at least 51% positive votes from our Owners. Amendments to our existing Covenants can be made with at least 66% positive votes from our Owners. PLEASE NOTE: Although the Owners had previously been provided access to documents containing all amendments being considered by the Board, not all of those amendments ended up being included in what you are being asked to vote on. The final proposed Bylaws and Covenants amendments, although not included in this ballot envelope mailed to you, are available for viewing by three different methods, the Sunshine Web site (link provided via SEPO Enews Email) posted outside the SEPO Office available to each SEPO street address if you wish to request the SEPO office (956-425-1420) to print a copy for you. The Board also plans to hold a series of Open Forums to enable Owners to inquire / become knowledgeable about the final proposed amendments to the SEPO Bylaws and Covenants 'prior to’ you voting. Cathy Richmond ​ Sent 2022-01-05: How to turn a dog into the Humane Society Harlingen, HSH - The stray pup that Lynne Reed found has been safely turned over to Humane Society Harlingen. We hope a Rescue group that works with them will take her out of state and find her a deserving home. The process to get a dog into the shelter is very different than in the past. HSH is now a no kill shelter but they will no longer accept turn-ins at their building. They want you to foster for them and they will provide the medical care food etc. Sometimes that is not possible, so this is what needs to happen. Harlingen Animal Control needs to pick up the animal and bring them to the shelter. They will only pick up at a Harlingen address. Many of us live in Combes. If Combes is contacted they will keep for 3 days then euthanize. Find a neighbor in Harlingen here to work with you. The phone number for Animal Control is the best kept secret in Harlingen. I kept getting sent back to the Shelter so I contacted Harlingen Police and THEY called Animal Control. I gave my phone number and animal control called me 10 minutes before they arrived. They double checked that they were coming to a Harlingen address. It shouldn't have to be so difficult but having the info fresh in my brain, I thought I would share because we know that wasn't our last stray! Hope this helps and thank you Lynne and Larry. As many of you know, the Board established a Review Committee in March 2021 to review our governing documents; Covenants, Bylaws, and Policies & Procedures. This Committee made several recommendations for changes. The Board reviewed these potential changes and forwarded them to our attorney, Matthew Thigpen. A great deal of time has been dedicated to this effort. The results of these reviews were a set of formatted legislative documents. They are draft proposed Amendments. Since publishing these same links last week the Board has received several comments from Owners expressing concerns about potential proposed changes. I want to make it known that our Board and the Review Committee, plan to vet any possible changes to our Owners before moving forward. Any change within our Covenants and Bylaws requires our Owners to approve by ballot in an election. Therefore, it is paramount that our Owners agree to a listing of final recommended amendments. How we do that has not yet been determined. I have called special Board meetings next week at 2:30 PM on both Tuesday and Thursday during which the Board will address the issues of concern we have received along with the other items described below. The primary purpose of these special Board meetings is for the Board to examine each of the proposed changes to our governing documents and arrive at a consensus that each change is appropriate or not. In every case there are specific reasons for the suggested changes. I believe it is important to hear each of the reasons or rational for the modifications and determine if it is an appropriate amendment. I would also like the Board to address how best to both educate and provide a method for Owners to comment on any proposed amendments. Owners have asked how this is going to be handled? The answer is we do not know yet. The Board has not addressed this issue. It is my hope we can establish a process during our special Board meetings which will be inclusive and would engage members of the original Review Committee, to arrive at any proposed amendments to our governing documents. We also have a chicken and egg issue. The Board needs to identify proposed final amendments documents first. After that determination, I anticipate the community would have an opportunity to comment on each proposed Board change. As of today, the Board has not accepted any proposed amendments that could be put before the Owners’ for review, comment, for an eventual vote. Providing an educational component to this process is essential if any of the Board proposed changes are to be considered and / or approved by our Owners. The Board anticipates we might want to have a series of meetings where the Community is invited to comment on specific changes. The Board, at the conclusion of these meetings, would then meet again to modify the Board proposed final changes or not. The Board wants to hear Owners’ concerns before the Board decides on any final proposed Amendments. It is the Board’s hope that at the special meeting next week we can finalize the processes to both educate the Owner’s and determine how to receive comments.     Pool - Hot tub - Pavilion The open air Pavilion next to the Pool and Hot tub plays host to many neighborhood gatherings and parties. ​ The pool is always available to Swimming, Sunbathing and Just enjoying the company of Friends & Neighbors. We have one coming in from Phoenix and should be here by Wednesday. We will try to have it installed as quickly as possible, so hopefully it will be up and running by the end of next week. Thank you for your patience and the way this weather has been, haven’t noticed a line of folks trying to get into the pool. Hot tub is working Great!!!!! Need your help!! The jets in the pool are adjusted to make the skimmers work more efficiently. They steer any floating objects like leaves towards the skimmers. If you try adjusting these jets it just cuts the way the water is moving towards the skimmers. We would like to ask you to leave the jets in the position they are in now. As of this afternoon the new equipment will have been installed. This involves a new, and much needed heater for the hot tub. The old one was not reliable so this should solve our problem and give us even heat in the hot tub. Also, there will be a new sand filter for both hot tub and pool. Sand will give us a better filtering system and be more efficient. This will not only give us a better filtering system, but make the chemicals do a better job. Lalo did his usual great job in the installation. Pat him on the back when you see him!!! We gave it a test run early this morning and it looks like it is going to do a great job. The cleaner will run when no one is in the pool. Therefore, it will do its’ work in the middle of the night. The cleaner will be set up and put in the pool at approximately 9:00 pm. It is OK to be in the pool at this time, just be careful of the cords. At about 4:00 am the cleaner will start and run for about 2 ½ hours. Lupe will then be here to remove the cleaner from the pool. During that run time, please stay out of pool. Thank you very much for you cooperation. This does not involve the hot tub, so that can be used as usual. It is in the plan to give the hot tub a special cleaning, and you will hear more about that later. There are to be no glass containers brought into this area. This is for obvious reasons. For your safety and others, this is a rule that MUST be followed. If glass drops and shatters, which it does, and you are barefoot, you will very much regret stepping on it. It is almost impossible to completely clean up and if it goes into the pool or hot tub, they must be drained and cleaned. Starting with setup for the HH and until everyone has entered the hall for dinner, the pool/pavilion area will be closed to only those participating in the tournament festivities. And the number of people who gave their time to prepare the food (special kudos to the kitchen help), served the food and drinks, baked cakes and cleaned up afterwards are thanked for spending their time and efforts to help the Woodshop as well. As some of you know, the Woodshop is replacing the current table saws with SAWSTOPS that instantaneously shut down should a finger or hand touch the blade when the machine is running. Thanks to Pat Harvey and his committee for undertaking this huge task. One of the SAWSTOPS will be purchased with Woodshop funds; the other through a fundraising effort. If you’d like to support the Woodshop in this project as well, you can do so by delivering a check to the Woodshop. Monitor trainings have been given by Jack Berning and there are currently 24 authorized monitors for the Woodshop; in January, 13 more people took the Orientation and Safety Class done by John Chajec. Consider giving woodworking a try! On Tuesday, February 4, from 6:00 p.m. to 9:00 p.m., Dennis Pickett will be teaching a class on lathing acrylics in the Woodshop. At the most recent meeting, the Woodworkers’ Club elected new officers for 2020. They include Cathy Chajec, Treasurer; Marian Young, Secretary; Jack Berning, Vice President; and Suzie Sawyer, President. The term of office begins on January 1, 2020. A heartfelt thank you to Chuck McEvoy who served as the Woodshop Secretary for 4 years. The membership was recently presented with a proposal to investigate the possible purchase of a miraculous table saw called SAWSTOP. If you google it, you will see that somehow the whole table saw shuts down in a flash if flesh or dampness touches the saw blade. A demonstration of the SAWSTOP was held on Tuesday, December 17, and over 30 woodworkers attended. All were amazed at the split-second response of the table saw that eliminates the hazard of being cut by the saw. At the January 10 meeting, the membership will consider purchasing a SAWSTOP from the treasury and having a fund-raising effort to purchase a second SAWSTOP. The technology is available to end the possibility of serious injuries on table saws, so the matter is worth addressing. We encourage woodworkers to attend the January 10 meeting at 1:00 p.m. at the Woodshop to vote on this matter. It is our hope that SEPO residents will once again support the Woodworkers’ Spaghetti Dinner scheduled for Tuesday, January 21. Cathy Chajec is again heading up the event and will need several 9x13 cakes, cooks, servers and a clean-up crew to provide a nice evening at Retzlaff Hall. Tickets will be on sale starting January 6 and can be purchased from members of the Woodworkers’ Club. THE WOODSHOP WILL BE CLOSED ON THANKSGIVING! It will also be closed on Friday, November 29, for maintenance. We are still a little short of having enough monitors to keep the shop open from Monday through Friday from 9:00 a.m.-noon and 1:00p.m.-4:00 p.m. So, if you go there for some reason and it is closed, bear with us. Things will perk up after the holidays. A section entitled "Resale Certificates" was added on page 1 to comply with Texas Property Code 207: RESALE CERTIFICATES To comply with Texas Property Code, Sec. 207, any owner selling his residence must provide a resale certificate to the buyer prior to closing. This must be done whether by sale through a realtor, or a private sale between individuals. This will be provided by SEPO not later than ten days following a request for same at a cost of $250. The resale certificate will provide, in part, the following information: Financial condition of the association, any unpaid amounts due the association on the property, any known violations of noncompliance for the property of the rules (Covenants) of the association. The "Property and Yard Maintenance" section, Item 1, was updated concerning the 'attempt' to make an initial phone call: PROPERTY AND YARD MAINTENANCE It is the responsibility of all property owners to see that their property and yard are maintained, mowed, and trimmed AT ALL TIMES. If it becomes necessary for SEPO to care for an owner’s property at any time, a service fee of $50.00 for mowing and $75.00 for weed removal of non-grass yards will be made each time such services are performed. There will be a service fee of $75.00 per incident to pick up fruit that has fallen from your fruit tree onto any Owner’s property or the street. Initially the SEPO Office must attempt to notify the owner via phone call. This will immediately be followed by a written notice from the SEPO Office that references the attempted or actual phone call and states the issue that needs to be addressed. This written notice may be handed to the owner of the premises or sent via e-mail or regular mail, or by posting the notice on or near the front door of the resident’s home at the property location. Owners will be given seven (7) days from the date of said phone call (attempted or completed) and the written notice to bring the premises into compliance before the SEPO services are scheduled. All owners must furnish SEPO office personnel with up-to-date information as to who is responsible for their property during the owner’s absence. Thanks for resending it to me Larry. From Larry Keller (SEPO Board Director): update on Texas ave - The front entrance area continues to look fantastic. Lalo, the Garden Club and many other volunteers have made the Texas ave area look better than ever. When you see Lalo be sure to thank him for his dedication to our community. Lalo will be pressure washing the concrete block wall on the south side of Texas ave very soon. The drainage ditch behind Minnesota has been cleaned out from Texas ave to the northern boundary by the storage lots. This was achieved with help from Alan Moore district 5 mgr, Joy Cossins, Caroline Cochran, Lassie Dahlstrom, Randy Davis and our SEPO staff. We have begun to trim some trees along the Minnessota ave tree line to avoid contact with the power lines. The front gate mechanism has had nearly all of the internal components replaced. A new lock was also installed to avoid tampering. We have had success the last few weeks with the gate operating properly. Continued issues with the gate will require we purchase a new opener. The motion passed unanimously. ​ PREVIOUS MEETING MINUTES President Tony Tramel asked the board if there were any items to discuss prior to approving the minutes from the May 20, 2021, Board meeting (Attachment 1 in Agenda) . MOTION: Mecca Henry motioned to approve the minutes as presented to the Board. Larry Keller seconded the motion. The motion passed unanimously. UNFINISHED BUSINESS Item #5 in the Agenda – Tony & Larry: Discussion & Board Approval/Rejection of contract with D&J Site Construction, in accordance with plans, specifications and contract documents noted as Ver11 and summarized in the Exhibit labeled “Sunshine Estate Country Club Summary of 2021 Road Project from D&J Site Construction dated 2021 05 27 (Attachment 2 in the Agenda) , which reflects a total estimated cost of $62,836. Tony reported there were extreme problems with trying to obtain competitive bids for the needed work on W Indiana Circle. Ten sets of plans were sent to various contractors with little to no response. Responses that were received stated the project was either too big or too small for them. Associated General Contractors (AGC) (who have access to 10s of contractors) were then contacted and sent the documents. Even with that exposure, we only received one bid (Rhyner Construction) and it was 50% more than we had allocated for the project. After doing a value engineering exercise to determine how we could reduce the cost of the project, we chose to reduce scope by only doing half of our original plan. We also reduced cost by indicating using ‘removed’ asphalt so it could be recycled into the finished pavement. After asking for bids on the reduced scope, the original bidder, Rhyner Construction, bid $58,312.32 and a new bidder, D&J Site Construction, bid $35.728.60. We then approached D&J and asked if they would consider doing the original scope of the project. They could do that for $49,536, and then also include needed miscellaneous spot repairs of approximately 250 square yards of pavement, primarily on W Michigan Ave, and asphalt crack sealing for a grand total of $62,836. At this point, rather than fielding questions from residents during the Board meeting, Tony indicated he would personally meet with any homeowner on W Indiana Circle and describe any details they wanted to know concerning what this project is about and how it will impact them during the construction timeframe. Larry Keller said there has been a LOT of time, work and consideration put into this effort to get us to this point. In meetings with both contractors, they felt this is being done right and professionally. Jean Burgoine noted the community was extremely fortunate to have Board members with the drive and the education/knowledge to get us here. There has been a great effort and a lot of time exerted and we have educated people working on this subject. We can rely on their guidance. MOTION: Based on what he has seen and in reviewing the contract Larry Keller motioned that the Board move to authorize President Tony Tramel to sign the contract with D&J Site Construction in accordance with the plans, specifications and contract documents. Jean seconded the motion. Board vote was unanimous to approve. Tony will work on getting all insurance and any other miscellaneous items addressed and get the contract signed, hopefully within the next week. ​ NEW BUSINESS A. Item #2 added to Agenda at start of meeting: Mecca Henry – The purchase of sod, which has already occurred. A check was written to an employee to pay for a service provided by that employee’s wife’s company. It was done this way because the wife is not a US citizen and has trouble cashing checks. This is in direct violation of IRS rules. An employee should not receive both a W2 form as an employee and a 1099 Misc form as a contractor for non-employee compensation. Mecca was given this information by our CPA last year and she had passed it on to the Board. If the TWC (TX Workforce Commission) finds out about this, we are going to have to pay taxes and fines on the money paid to the employee for the work done by his wife’s company because we paid it to an employee. The check has already been cashed. At this point we can’t stop it. Mecca’s point in bringing this up is that we can’t ever do this again . We may have to pay a little more upfront for work we need done, but we won’t want to have to pay at a later day for any inappropriate action. Larry didn’t think there was any intention of deception. We have now all been made aware and it should not be done again. Everyone agreed there was no need for any kind of motion. This item is appearing in the minutes as an acknowledgment that the Board has heard Mecca’s statements and that, as a Board, we will do the right thing ongoing. B. Item #3 added to Agenda at start of meeting: Mecca Henry – The sale of a ‘SEPO owned’ trailer. Mecca has been made aware that we have sold a trailer to an individual, Fabian Flores. As this is SEPO property the sale should have been discussed by the Board prior to the sale occurring. Because this has happened in the past does not make it right. MOTION: Mecca Henry motioned that all sales of SEPO assets, whatever their value, should be discussed by the board prior to the sale. Lenore seconded the motion. Discussion - Larry asked if we had an asset inventory. Mecca indicated we do but has no idea if it is accurate. This a project that needs to be undertaken – clean up the list. There was additional discussion on how asset depreciation was calculated and how Mecca goes through SEPO records and also talks with the CPA to determine an asset’s value. Vote - The motion was approved five (5) to one (1) with Lyn Swonger representing the ‘no’ vote. Beth Parrish asked if we needed to approve ‘after the fact’ the sale of this trailer. Lyn Swonger said a new trailer was purchased last year. The trailer being sold needs lots of repairs. However, Lyn thought it was worth more than $400, which is the most that has been offered for it in the past. We still have the trailer in our possession and have received $300 (of the $600 selling price) from Fabian. That money is in the SEPO office. MOTION: Larry Keller moved to approve the sale of the trailer for a sum of $600 and authorize Lyn Swonger to sell it. Jean seconded the motion. A value engineering exercise caused us to reduce the scope of the project pertaining to curb replacement by 50% and also permitted the use of recycled material / asphalt to be incorporated into the specifications. A bid for this reduced scope was then solicited from both Rhyner Construction and D&J Site Construction. Rhyner Construction’s bid was $58,312.32 and D&J Site Construction’s was $35.728.60 for the reduced scope. With this knowledge it appeared SEPO could do the full project as originally designed for a cost of $49,536 for W Indiana Circle, provide needed miscellaneous spot repairs of approximately 250 square yards of pavement primarily on W Michigan Ave, and asphalt crack sealing for a grand total of $62,836. It is recommended SEPO enter a contract with D&J Site Construction, in accordance with plans, specifications and contract documents noted as Ver11, and summarized in the attached Exhibit (Attachment 2) labeled “Sunshine Estate Country Club Summary of 2021 Road Project from D&J Site Construction dated 2021 05 27, which reflects a total estimated cost of $62,836. This firm is celebrating its 50th Anniversary. They are qualified and competent contractors. A motion to Authorize the President to take this recommended action is requested. REPORTS OF OFFICERS Lyn Swonger - Golf Course Tony reported that Lyn had been inspecting the golf course this morning assessing if there had been any damage as a result of the recent rain. Jean Burgoine (Common Grounds/Maint. Area 1) SEPO Buildings The hot tub heater is down due to a leak. We are getting a new motor for the AC unit in Retzlaff Hall that will cost approximately $2000. The Pavilion area is going to be repainted to help keep people from slipping. This project has been moved up before redoing the showers because of the safety issue. There was a crack in the ceiling in the Billiards Room – Lalo has put spackling over the crack and is waiting for it to dry. Then he will paint it. Larry thought we might be having some ‘settling’ issues in those buildings. Tony indicated we probably want to incorporate this into the discussion of the Capital Improvements program. Larry Keller (Common Grounds/Maint. Area 2) Streets, Drainage & Irrigation Ditches, Texas Ave We have been cleaning up Michigan Ave, particularly burying/removing some of the inappropriate pipes and other items. The front entrance has been re-landscaped. We are trying to adjust the sprinklers around Retzlaff Hall to cut down on the amount of water that is accumulating on Michigan Ave. The Siren Sensor Board at the front gate was causing the gate to hesitate and not close. This board cost $500-$600 to replace. Tony reported that while testing the new board with the technician, it didn’t work properly either. Another new board has been ordered and Tony will test this new one with the technician – hopefully, next week. See Indiana Circle update below. Lenore Combs (Common Grounds/Maint. Area 3) Storage & Woodshop, Tennis/Pickleball & Shuffleboard She thanked Pat Harvey and Vic Hilman for the new can shed shutters and picket fence. She is looking to put a Roadbed in the storage lot – from the gate to the tree debris area. It will be a designated area of “where to drive in and out of the storage lot”. It will protect the individual lot rental areas and keep the lines/ropes designating each lot from needing to be constantly restriped. She is going to look into a product suggested by Larry Keller and work up a spec sheet to present to the board for review and vote. She thanked the SEPO staff for weeding and all the other work they do in the Lot. She is concerned about residents not taking care of their rental lots. There is lots of debris and loose items that need to be cleaned up. Larry asked if residents signed anything when they rented a lot. Beth confirmed there is a one-page Lot Rental Agreement that the residents sign at the beginning of each year. Lenore will get a copy of this form, rework it as needed and present it to the board for review and vote. Harlingen and Combes were upset over the tree debris being dumped in the Storage Lot due to the cost of removing it. It used to be that when a vendor trimmed the palm trees, they would haul the trimmings away. Now they are put in the storage lot. Lenore investigated having them recycled, but it was too costly. She will continue to monitor this situation. John Chajec donated a practice tee net. Lenore is looking for assistance to get it put up. She is still looking into a new Surveillance system(s). The current plan is to do one area at a time – Front first, then woodshop, then antennas, cameras and other areas. Tony has some info that may assist with this effort. Mecca Henry - Treasurer - Financial Status / Reports Mecca need to get Board approval of the Feb, Mar & Apr 2021 financial statements. Larry moved to approve them. Beth seconded the motion. All present approved. Mecca volunteered to provide background material to the directors supporting areas they may not be all that familiar with. She can gather that information at the same time she is creating the budget sheets. Tony hopes to have a special meeting on Budget preparation. Tony Tramel - President Tony is concentrating on resolving issues with residents who are guilty of SEPO Covenant violations. He is of the belief they have all been resolved except one that the Board is currently dealing with. Prior to this meeting the Board was polled (via Google Form) to determine where everyone stood on lifting SEPO Covid-19 restrictions. There were varied opinions. After investigating if the results from such a poll could constitute an official Board vote, it is now Tony’s belief that it does not. The use of this type of inquiry into Board matters will be discontinued. All items requiring a Board vote will be placed on a Board agenda and discussed/voted on at a Board meeting. NEW BUSINESS Board - SEPO & Covid-19 Restrictions (Attachment 2 in Agenda) Lyn Swonger joined the meeting at this point. Everyone who wanted to voiced their opinion on lifting SEPO Covid-19 restrictions. Beth Parrish & Larry Keller – Seeing how things have started opening up around the country they wanted to drop all restrictions. Lenore – People are going to get vaccinated or not. The responsibility is on each individual to take care of themselves. She wants to open everything. Lyn Swonger – Stated there were 11 new Covid-19 cases in Cameron Co today and a total of 128 in May. Although people need to be responsible for themselves, what about non-vaccinated people who may start coming into Sunshine? Jean – Wants to drop all restrictions. Larry made a motion to drop all current Covid-19 restrictions in SEPO previously initiated by SEPO boards. Lenore seconded the motion. Voice Vote was: Lyn Swonger and Mecca Henry – no, Jean Burgoine, Larry Keller, Lenore Combs and Beth Parrish – yes. The motion passed – four to two - effective immediately. Beth will compose an e-mail for Tony’s review that will be sent to the community documenting this decision. Mecca Henry – Reserve Fund Tony indicated we need to have an account designated for the Reserve Fund. Mecca stated the Frost Money Market has $104,000 in it that would accessible as soon as/if needed. Mecca Henry motioned that we designate the Frost MM as our Reserve Fund. Lenore seconded it. The vote was a unanimous yes by acclamation. Lenore Combs – Storage Lot Most of the items in the agenda has already been discussed in Lenore’s status report above. Storage Lot 504 - Women’s Club property: This lot contains two sheds. Lenore needs to get with Marian Young (Women's Club) and Lassey Dahlstrom (who is familiar with many items in the sheds on this lot) to discuss next steps for repairing these sheds to avoid damage and/or theft of items stored inside them. Can Shed (added during meeting): This is not a ‘garbage’ can shed. Residents need to be more diligent about cleaning out their cans (remove food etc) before putting them in this shed. Beth – 4 O’clock Golf Scramble (Attachment 3 in Agenda) The board had previously questioned whether this was a SEPO-sanctioned golf event. Tony found a document describing it – what, who, when etc - but wasn’t sure if it had been previously approved by a Board or if anyone, other than those who gave it to him, had ever seen it. Beth updated it and requested the Board approve it. Due to the start time of this event varying depending on how long it stays light and how hot it is, the following occurred. Jean moved we change the name to the “O’Clockers Golf Group”. Beth seconded it. It was approved unanimously by acclamation. Jean then moved to approve the document, with the name change. Larry seconded it. It was approved unanimously by acclamation. Beth will update the document accordingly and get it distributed to 1) those residents who run/guide this event, 2) the SEPO Office 3) to the community and 4) on the Web site. (See Attachment 1 - Updated document) Tony – Fair Housing Exemption and selection of an HOA knowledgeable attorney. The Rules Review Committee uncovered items related to Fair Housing Act that we currently aren’t conforming to. It appears we need a documented survey method occurring “every two years” or process for gathering certain information. Tony would like to move forward with developing something and getting the rest of the board more involved. We need to find a new attorney in the next month or two as our current one is retiring. He/She needs to at least be knowledgeable (even if not an expert) of HOA laws. How do people know this is a 55+ community? Tony and Larry are proposing we place the following text/numbers at the front entrance, so it reads “A Senior Community (55+)”. Tony and Valerie have come up with a procedure for new residents that are selling or reselling property in order to issue them a resale certificate (which is what occurs and is required by TX RE Law) to document and agree to our Covenants, By-Laws and Policy and Procedures, before they purchase a home in Sunshine Estates. UNFINISHED BUSINESS Lenore – All items had already been discussed. Beth – Employee Handbook Update Clarification (Attachment 4 in Agenda) Only the proposed updates were included in the Agenda. Lenore made a motion to approve the changes. Jean seconded it. Open discussion – Lyn had a problem with two 15-minute breaks, which was an item that had been approved previously during a meeting on March 8, which he had not been able to attend. He said for the past three years, the Golf Course employees had taken a break from 10-10:30 for breakfast and then from 12:30 to 1 for lunch. The discussion ended with Lenore rescinding her motion until this was resolved. The next step is to ensure, if we leave the current handbook as it is (stating two 15-minute breaks) but continue to let the Golf Course employees take them in a 30-minute bundle, as they currently do, that we are in compliance with Federal and State work requirements. Tony suggested 2-3 board members pursue this; put a draft together and send it to the entire board. All handbook updates will then be on the next Board meeting agenda for a vote. Tony – Committee review of Policies, Bylaws, and Covenants The Board will have a special meeting on June 24 (if that day works for everyone) to review the committee’s recommendations and develop an action plan on how/when changes, if there are any, ‘can’ be implemented. Larry & Tony – Current Status of W Indiana Circle bid process We have reached out to several general contractors. One attended a meeting to discuss our proposal. His estimate was much too costly. We then revised what we would like to have done and are still waiting on a new cost estimate. Larry has since found another general contractor that we hope can work with us. When we find someone to do this work, we will report to the board with the details and ask for approval. If not approved, it’s back to the drawing board. At some point during this process the proposal for work to be performed will be presented to those residents who live on W Indiana Circle for review/input. Tony - SEPO complaints and resolution of same Each Thursday, Tony reviews any Suggestion/Complaint forms submitted in the box in the Office and has addressed most of them himself. He agrees with Beth that a formal process for submitting Suggestion/Complaint forms needs to be developed and the community informed of said process. Tony - Committee to develop a 3–5-year capital improvement program. Tony hopes to put together a draft to use to start taking action on this item. Tony – Reinstatement of Golf Trail Fees and date of reinstatement, if approved. There has been some discussion about whether we should re-instate these fees and the corresponding language that would go with them. Jean and Lyn questioned what the fees would be used for. Tony indicated they would be used for trail maintenance and other amenities that would be directly associated with the golf course itself, i.e., landscaping, water pumps, fountains, major irrigation changes. Tony will prepare a report for Board review/vote at the next meeting. Tony & Mecca – Reserve Fund: Was previously discussed. Tony – What is status of ACC updating their process and revising the request form? Tony attended the last ACC mtg as a Board rep. They are in discussions about creating a new submission form that would include why a permit was denied. They are also looking into what the Board can legally do if a resident who has been denied a request continues with the work in spite of it being denied by the ACC. Sunshine Country Club Estates Four O'clock Golf Scramble The Four O'clock Golf scramble is a golf event approved by the SEPO Board. Therefore, it shall adhere to all the same rules as other SEPO approved golf events. Play shall commence at 4:00 pm each day and may be delayed, postponed or canceled when conflicting with special events (IE: Good Neighbor Golf Tournament), or prior established events (IE: 3:00 pm Thursday Golf Scramble). (NOTE: During warmer months the start time often gets pushed back to avoid the worst heat of the day.) The Four O'clock Golf Scramble is open to all Sunshine Country Club Estate residents and renters and their immediate family and guests. This is a shotgun start best ball scramble. Teams and start hole will be determined by a random draw. The number of start holes and team size will be determined by the number of players present. At no time shall any team exceed five players. No advance signup is necessary. Player's meet at 4:00 pm (or a later designated time) in the parking lot outside the SEPO office. Team one will commence play on hole one and other teams will start on consecutive holes two, three, four, etc. There is no cost to play. Therefore, no prize monies are paid. In an effort to accommodate all golfers not participating in the 4 O’clock Scramble, individual players may tee off following the scramble team on hole one. Participants shall adhere to normal golf etiquette by allowing players already on the course to complete their hole before proceeding. Example: The scramble consists of four teams starting on holes one through four. There is already a group on hole two preparing to tee off. Scramble Teams on hole one, three and four may proceed to tee off. But the Scramble team on hole two must wait until the group already there completes that hole and moves on. The course is not closed for this scramble. Hours of Work A normal work week for hourly Maintenance employees (Golf Course and Groundskeeper) is 40 hours from 7:00 am to 3:30 pm, Monday through Friday. Each Maintenance employee is entitled to a 30-minute unpaid and uninterrupted period of time for their lunch break and two paid 15-minute breaks each workday. Bookkeeper Perform new resident orientations all year . Custodian Must perform other duties as assigned. Golf Course Lead Required to exercise independent judgment. He must maintain open communication with the Bookkeeper and Board Members. It was designed to honor Armed Forces who gave their all during service to our Nation. And we are especially grateful to these families. We shall celebrate and give thanks. Aside from decorating Veterans graves, parades an d services are often held but after WWII, the purpose broadened and now recognizes all those who have served in all American Wars. The National Remembrance Act - Moment of Silence - pause at 3pm local time. (We will incorporate this with the program at the Gazebo). Sunshine is a proud community and there are 2 parts to our Memorial Day program - the Veterans Tribute (Golf Cart Parade & Gazebo Program) and the Pot Luck which will follow shortly thereafter in Retz Hall. There is a sign up sheet in the Library. For the Parade and Gazebo part, I am looking for volunteers to help with several facets. The Pot Luck Team are doing their thing at Retz Hall. John and I need Flag Bearers to carry the Branch Flags and 2 escorts with wooden rifles (that don't shoot). Hoppy will help with sound. John will help with the Flag ceremony. I need 2 Neighborhood Watch volunteers to mark the area by the Gazebo from where the Flags will enter. We appreciate your 2 CENTs and can have a brief meeting on Tues or Weds the 16th and/or 17th of May. Let's meet at the Office and go from there. We're starting by having a golf cart parade around the neighborhood at 2:00 pm followed by a short ceremony at the gazebo. We'll all meet back at Retzlaff Hall at 4:00 pm for a potluck. There is a signup sheet in the library for those of you who want to bring food. Also there's going to be a memorial board that you can use to put up pictures of your loved ones who have served in the past. Please put your name and number on the back to I can get them back to you. I'll send out a notice when the board is ready for you to start putting up your memories. Hope to see all of you there.
