Dear Friends - Happy New Year to one and all.  We shall have a meeting tomorrow - Monday 17 Jan 2022 at 3pm. Linda Jones will be presiding.  Please be there also because Tony Tramel will be there to answer any questions about some Board decisions on amendments etc.   
 
We are losing Patrol volunteers and this is the backbone of NW.
Just the other day, we called for an ATP because of suspicious activity.  The Bad Guys never take a day off and if it was not for your "eyes and ears", it begs the question of the good luck we have enjoyed.  Keep up the good work.  Don't forget to say Thanks to our PD in Combes and Harlingen because they keep an eye on us. 
 
Also, please everyone, (residents too), remember to secure the doors when leaving.

Sent 2022-01-16: INFO/WHERE TO FIND Proposed Amendments to SEPO Bylaws & Covenants for 2022 Vote - 

The Governing Rules documents you are being asked to vote on in the 2022 election, which contain proposed amendments to the Bylaws and Covenants, have been posted on the Sunshine Web site HERE.

The ballots for voting on these amendments, along with voting instructions, were mailed to the entire community via US Postal Service on Friday, January 14, 2022.
 
Between the asterisks below is one of the pages you will be receiving in your ballot envelope. Here is a bit more comprehensive explanation of how the voting percentages works:

  • Amendments to our existing Bylaws can only be made if 51% of the "total" votes cast are yes.

  • Amendments to our existing Covenants can only be made with at least 66% yes votes from the owners (202 yes of the 306 owners).

CONCERNING PROPOSED AMENDMENTS TO SEPO Bylaws and Covenants
 
The SEPO Board appointed a Review Committee of knowledgeable Owners in March 2021 to review our SEPO Bylaws, Covenants and Policies & Procedures. This Committee consisted of Share Nelson, Pat Harvey, Jerry Wetherbee, Earl Weir and Steve Fransene.
 
After intense review, the committee provided a report to the Board. The Board accepted this report and proceeded to undertake significant effort to review their recommendations, ultimately forwarding them to our Attorney. The Attorney provided input to the Review Committee recommendations and also provided updates to our Bylaws and Covenants pertaining to current Texas Property Code. After another intense Board review and consideration of Owners’ comments, the Board approved to ‘move forward for a vote’ documents containing proposed amendments to our Bylaws and Covenants. The proposed amendments in both documents are classified as:

  • Necessary to follow the current Texas Property Code, or

  • Corrective, editorial, and / or changed for clarity (without changing the intent).

Amendments to our existing Bylaws can be made with at least 51% positive votes from our Owners.
 
Amendments to our existing Covenants can be made with at least 66% positive votes from our Owners.
 
PLEASE NOTE: Although the Owners had previously been provided access to documents containing all amendments being considered by the Board, not all of those amendments ended up being included in what you are being asked to vote on.
 
The final proposed Bylaws and Covenants amendments, although not included in this ballot envelope mailed to you, are available for viewing by three different methods,

  1. the Sunshine Web site (link provided via SEPO Enews Email)

  2. posted outside the SEPO Office

  3. available to each SEPO street address if you wish to request the SEPO office (956-425-1420) to print a copy for you.
     

The Board also plans to hold a series of Open Forums to enable Owners to inquire / become knowledgeable about the final proposed amendments to the SEPO Bylaws and Covenants 'prior to’ you voting. Watch for details to be communicated concerning these forums.

We are announcing exciting changes to the SEPO history slide show in the hall on January 18th.

Instead of popcorn and ice cream we are having Champagne punch and hors d’oeuvres!

This slide show has been updated to explore the history of Sunshine Estates from the beginning to now.
All residents are invited and our newer residents will find this particularly interesting.

Doors to the hall will open at 5:30 with the show starting at 6PM.

We will also provide iced tea and water but feel free to BYOB.

Fred's wife Jean wants everyone to know that Fred passed away at home about 9:30 last evening (1/10/22). I have lost a model airplane buddy and a Whataburger breakfast partner. We all lost a card player and dancer.

Two updates to the Policies & Procedures were approved by the Board at the 'Residents & Directors' meeting on Jan 6, 2022. The Web site has been updated to reflect these changes.

  1. GOLF COURSE – Line items #13 and #16 were duplicates.

    Anyone wishing to use a riding golf cart to play golf may do so by paying an annual Golf Course Improvement fee. A sticker must be purchased each year and placed in plain view on the windshield of the cart.
     

  2. SEPO BUSINESS MEETING ROOM was changed to MULTI-PURPOSE ROOM

    and the description of this room was also changed.

    SEPO BUSINESS MEETING ROOM:

    This room is located within the Pavilion and is to provide a smaller, quiet space for groups to meet and conduct business. It will not be open on a day-to-day basis and must be reserved through the office. It will be locked at all other times. Upon making a reservation a key will be provided and signed for. It must be returned in a timely manner following the meeting. For an emergency or spontaneous meeting on a weekend or evening when the office is not open, you may contact a Board Member for availability and a key. It will be used for but not limited to meetings of the SEPO Board.

    WAS CHANGED TO THIS:

    MULTI-PURPOSE ROOM.
    This room is located between the Pavilion and the Fitness Room and can be used for multiple purposes including to store mail packages too big to fit in your mailbox. This room is locked at all times with a keypad lock. If you would like to reserve this room you need to follow the normal Activity Request process.

As stated in Section 6.01 of the Bylaws at the bottom of this e-mail, the Board is required to inform the community of the names of the nominees presented to them and then accepted by the Board to run for the upcoming 2022 SEPO Board election.

Cathy Richmond (Nominating Committee Chair) presented the names at the "Res & Dir" meeting on Jan 4, 2022. After this meeting the Board confirmed that the four nominees presented to them by the Nominating Committee are all in good standing with the community.

Here is the report which I will be posting in the Office, on the poolside door into Retzlaff Hall and by the mailboxes in a few minutes.

President Tony Tramel pointed out these four names had been posted in the SEPO Office for the 10 days required by SEPO Bylaws.
 
Lenore Combs moved and Jean Burgoine seconded to “Accept the Nominating Committee nominations as stated”. The motion passed unanimously by the Board.
 
President Tony Tramel asked if there were any Nominations from the floor. There were none.
 
President Tony Tramel declared the nominations closed for the upcoming SEPO election on February 15, 2022 at the Annual Shareholders meeting.

ARTICLE VI-COMMITTEES
 
Nominations and Ballots

 

6.01  The Board of Directors shall, at least sixty (60) days before the election, appoint a Nominating Committee of three (3) to five (5) members to submit a slate of nominees for Directors to be placed on a ballot for hand delivery or mailing to members.  The nominating committee shall post its selection of Nominees at least ten (10) days prior to the January Meeting of Residents and Directors.  The Committee shall submit its nominations to the members at the January meeting of Residents and Directors and nominations from the floor will be accepted.  The Board shall thereupon validate the status of members, as defined under Article II herein, and cause the committee report to be posted on the Club House bulletin board for a ten (10) day period.  At or about noon of the tenth day the report will be removed from the bulletin board.  A paper ballot shall be prepared, under the direction of the Board of Directors, to include the nominations of Directors and other items authorized to appear on the ballot.  The ballot must be hand delivered or mailed to all members of record (Article II) along with notice of the Annual Meeting.  Each returned ballot will be held unopened until the Annual Meeting.  A tally committee of which no member shall be an interested person or related to an interested person, will be appointed by the Board of Directors, from the attending members to count the ballots for Directors and other items that may be on the ballot. A PLURALITY VOTE, which is the largest number of votes to be given any candidate when three (3) or more choices are possible, will be the basis for election to the S.E.P.O. Board of Directors.  A majority vote will be needed for all other By-Law changes. Results are to be announced at the proper time in the meeting.  All votes cast shall be by ballot only.

Sent 2022-01-05: How to turn a dog into the Humane Society Harlingen, HSH - 

The stray pup that Lynne Reed found has been safely turned over to Humane Society Harlingen. We hope a Rescue group that works with them will take her out of state and find her a deserving home.

The process to get a dog into the shelter is very different than in the past. HSH is now a no kill shelter but they will no longer accept turn-ins at their building. They want you to foster for them and they will provide the medical care food etc.

Sometimes that is not possible, so this is what needs to happen. Harlingen Animal Control needs to pick up the animal and bring them to the shelter. They will only pick up at a Harlingen address. Many of us live in Combes. If Combes is contacted they will keep for 3 days then euthanize. Find a neighbor in Harlingen here to work with you.

The phone number for Animal Control is the best kept secret in Harlingen. I kept getting sent back to the Shelter so I contacted Harlingen Police and THEY called Animal Control. I gave my phone number and animal control called me 10 minutes before they arrived. They double checked that they were coming to a Harlingen address.

It shouldn't have to be so difficult but having the info fresh in my brain, I thought I would share because we know that wasn't our last stray!

Sent 2022-01-02: REPLY TO COMMUNITY CONCERNING NEXT STEPS FOR PROPOSED RULES CHANGES - 

Our original governing documents were created in 1985, some 30 plus years ago. As many of you know, the Board established a Review Committee in March 2021 to review our governing documents; Covenants, Bylaws, and Policies & Procedures. This Committee made several recommendations for changes. The Board reviewed these potential changes and forwarded them to our attorney, Matthew Thigpen. A great deal of time has been dedicated to this effort. The results of these reviews were a set of formatted legislative documents.

The Board has not yet reviewed these last three documents in a Board meeting. They are draft proposed Amendments.
 
Since publishing these same links last week the Board has received several comments from Owners expressing concerns about potential proposed changes. I want to make it known that our Board and the Review Committee, plan to vet any possible changes to our Owners before moving forward. Any change within our Covenants and Bylaws requires our Owners to approve by ballot in an election. Therefore, it is paramount that our Owners agree to a listing of final recommended amendments. How we do that has not yet been determined.
 
I have called special Board meetings next week at 2:30 PM on both Tuesday and Thursday during which the Board will address the issues of concern we have received along with the other items described below.
 
The primary purpose of these special Board meetings is for the Board to examine each of the proposed changes to our governing documents and arrive at a consensus that each change is appropriate or not. In every case there are specific reasons for the suggested changes. I believe it is important to hear each of the reasons or rational for the modifications and determine if it is an appropriate amendment.
 
I would also like the Board to address how best to both educate and provide a method for Owners to comment on any proposed amendments. Owners have asked how this is going to be handled? The answer is we do not know yet. The Board has not addressed this issue.
 
It is my hope we can establish a process during our special Board meetings which will be inclusive and would engage members of the original Review Committee, to arrive at any proposed amendments to our governing documents.
 
We also have a chicken and egg issue. The Board needs to identify proposed final amendments documents first. After that determination, I anticipate the community would have an opportunity to comment on each proposed Board change. As of today, the Board has not accepted any proposed amendments that could be put before the Owners’ for review, comment, for an eventual vote.
 
Providing an educational component to this process is essential if any of the Board proposed changes are to be considered and / or approved by our Owners. The Board anticipates we might want to have a series of meetings where the Community is invited to comment on specific changes. The Board, at the conclusion of these meetings, would then meet again to modify the Board proposed final changes or not.
 
The Board wants to hear Owners’ concerns before the Board decides on any final proposed Amendments. It is the Board’s hope that at the special meeting next week we can finalize the processes to both educate the Owner’s and determine how to receive comments.

I did it a little earlier than I said I would, but I just now updated the password that provides access to the 'Residents' section of the Sunshine Web site. It is case sensitive. Keep it in a safe place where you have easy access to it.

Please read the e-mail below which I sent out yesterday as an advance notice of this upcoming change - in particular as it pertains to those of you who have Renters currently in your homes.

Dear residents - Stained glass class will begin this Thursday at 6:30 p.m. in the woodshop.  Please dress according to the weather.  The class is open to all residents, so the following disclaimer must be understood by all:
 
Everyone attending the stained glass class by their presence, acknowledges potential exposure to Covid-19.  Each person is responsible for his/her own choice as it relates to attending this class.
 
We will be working in fairly close proximity to one another, so if you feel the need to wear a mask, please do so.  If you are not feeling well, please stay home.

As in January of previous years the Sunshine Web site password will be changing to help keep current resident/renter information as private as possible. This change will be made sometime during the hours of 6 PM & 8 PM the evening of Sunday, January 2, 2022. It will take 30-45 minutes to complete this process. If you are attempting to access the Residents’ section of the Web site during this timeframe some pages may require the old Password while others may require the new Password. I will be sending an e-mail to the community on Saturday, Jan 1, 2022 with the new Password so you are prepared when the update is made. Thanks in advance for your patience with this process.

This e-mail is being sent to only current OWNERS of property in Sunshine Country Club Estates. If you have a renter in your property it will be your responsibility to inform them of this password change and ask them not to share it with anyone outside of those renting your home.
 

You wouldn't want your 'private' information available to just anyone, would you?​​
